JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504 of the Indian Penal Code.

It is alleged that petitioner came at the door of the informant in intoxicant condition and started abusing and when wife of the informant made protest then he inflicted injury with dab on her head.

It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. The injury has been found to be simple and for the occurrence of 18.10.2015 the F.I.R has been registered on 19.10.2015 when the police station is only 2 K.M away from the place of occurrence.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.58049 of 2015 (2) dt.04-01-2016 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Baikunthpur P.S. Case No. 183 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Gopalganj. With the observations above, the application stands disposed off.
