The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.

The prosecution case in nutshell is that petitioner and co-accused persons assured the informant to provide job to his son, namely, Pradip Kumar Yadav, if he pays Eight Lakhs rupees. On the trust, informant paid Rs. Eight Lakhs to the petitioner and co-accused persons for the said purpose but they did not provide

Patna High Court CR. MISC. No.46460 of 2022(5) dt.14-02-2023 2/3 any job to the son of the informant. When the informant started demanding his money, petitioner along with other co-accused persons threatened him of dire consequences.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. During the pendency of the investigation of the case, the informant and the petitioner has entered into a compromise. Though the petitioner was not named in the FIR and his name sprang up during investigation of this case and charge sheet was submitted against 6 accused persons including the petitioners, who were on Bail. Moreover, the petitioner is languishing in judicial custody since 13.05.2022. It is also submitted that similarly situated co-accused, namely, Yugal Yadav, has been granted anticipatory bail vide order dated 11.01.2023, passed in Cr. Misc. no. 55095 of 2022 by the co-ordinate Bench of this Court.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Chakai P.S. Case No. 229 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui.
