20-09-2016 Heard Sri Sanjay Kumar, learned counsel for petitioners and Sri Suresh Prasad Singh, learned Addl. Public Prosecutor.

Four petitioners, apprehending their arrest in Jamhore P.S. Case No. 23 of 2016 registered for offence under Sections 341, 323, 379, 308, 504/34 of the Indian Penal Code, have prayed for grant of anticipatory bail.

It was submitted by learned counsel for petitioners that on perusal of F.I.R. itself, it is evident that petitioner no. 1 is own uncle of the informant and petitioner no. 2 is son of petitioner no. 1 and with regard to petitioner no. 3 & 4, there is allegation that they were instigating to commit the crime. He submits that

Patna High Court Cr.Misc. No.39083 of 2016 (2) dt.20-09-2016 2/2 injuries were found simple in nature and accordingly, a prayer has been made to grant anticipatory bail.

However, after going through the F.I.R., the Court is satisfied that it is not a case for grant of anticipatory bail. Dismissed.
