This is an application for bail in connection with Salkhua P.S.Case No. 67 of 2017 registered for the offences punishable under Sections 307, 333, 353, 393, 120B/34 of the Indian Penal Code and 25(1-B) A, 26, 27, 29 & 35 of the Arms Act. Petitioner has not been arrested at the spot. However, he has been made accused on disclosure by co-accused. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has no criminal antecedent and other co-accused have been granted bail by co-ordinate Benches of this Court, vide orders contained in Annexure-2 & 2/1 and he is in custody 29.8.2017. Heard learned APP also.

No.56391 of 2017 (2) dt.23-11-2017 2/2 Having heard both sides and considering the facts and circumstances of the case, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Saharsa, in connection with Salkhua P.S.Case No. 67 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court, except showing any genuine reason, failing which his bail bond shall be cancelled.
