JUSTICE SANJAY PRIYA ORAL ORDER 03-12-2018 Heard the learned counsel for the petitioners, the informant and the learned A.P.P. for the State. The petitioners seek bail in Bhagwanpur P.S. Case No. 146/2018, instituted for offences under Sections 147, 148, 341, 323, 307 and 504 of the Indian Penal Code. Learned counsel for the petitioners has submitted that there is land dispute between the parties. The land in question was settled in the name of these petitioners and order of settlement was affirmed by the Hon'ble High Court. Petitioners' side have also sustained injuries in the counter case, which has been filed by petitioner no. 2, namely, Lutawan vide

Patna High Court Cr.Misc. No.66190 of 2018(3) dt.03-12-2018 2/2 Bhagwanpur P.S. Case No. 145/2018 against the informant and other family members, in which some persons have sustained grievous injuries. In the instant case, injuries sustained on the person of injured are simple in nature.

Petitioners are in custody since 02.08.2018.

Learned counsel for informant has opposed the prayer for bail of petitioners.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabhua in connection with Bhagwanpur P.S.
