The petitioner seeks bail in connection with Pirpainti (Ekchari) P.S. Case no. 292 of 2005 registered for the offence punishable under Sections 324, 307 and 504/34 of the Indian Penal Code and under Section 27 of the Arms Act. Two rivalry groups including the petitioner as the member of one of the group involved in the shoot out to establish supremacy regarding fishing in the pond in which one person was injured, but he was taken away by his group men. It is submitted by the learned counsel for the petitioner that the allegation levelled against the petitioner is not specific rather omnibus. He has not committed any occurrence. The petitioner has been languishing in custody since 06.02.2017.

Patna High Court Cr.Misc. No.53831 of 2017 (2) dt.09-11-2017 2/2 On the other hand, learned APP for the State submitted that the petitioner was declared absconder on 22.05.2012 and has been remanded in this case from other case. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned IIIrd A.D.J. Bhagalpur in connection with Pirpainti (Ekchari) P.S. Case no. 292 of 2005. (Prakash Chandra Jaiswal, J) rohit/- U T
