JUSTICE SUDHIR SINGH ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 376(D) of the Indian Penal Code. Allegation against the petitioner is that he along with one co-accused had committed rape upon the informant. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case due to village politics. The medical examination report does not support the allegation made in the F.I.R. On behalf of the State, it is submitted that petitioner is named in the F.I.R. There is specific allegation against the petitioner for committing the offence.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.
Any how, if petitioner surrenders in the court below, i.e., C.J.M.,Bhojpur at Ara in connection with Mahila P.S. Case no. 109 of 2015, within a period of six weeks from today and prays for regular bail, same shall be considered and disposed of on its
