In this application for anticipatory bail the petitioner apprehends his arrest in connection with Shri Nagar P.S. Case No. 62 of 2014 for the offences punishable under sections 420, 467, 468, 406, 379, 323, 504 and 120 (B) of the I.P.C. It is submitted on behalf of the petitioner that in this case other co-accused, namely, Bibi Halima Khatoon, Bibi Jaibun Nisha and Md. Firoz Alam have been allowed pre-arrest bail vide Cr. Misc. No. 52470 of 2015 by another co-ordinate Bench of this Court and the petitioner has been unnecessarily dragged in this case and as such he also deserves sympathetic consideration. The sale deed was executed in the year 2012 and the case was
Patna High Court Cr.Misc. No.2213 of 2017 (2) dt.23-01-2017 2/2 instituted on 19.07.2014 and the delay has not been explained by the prosecution and the matter relates to the civil dispute. The learned A.P.P. submits that the petitioner is also named in the FIR.
In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Madhepura in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
