JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2023 The present writ petition has been filed seeking the following relief:- "1.i) To issue an appropriate writ preferably in the nature of mandamus commanding upon the respondent authorities to initiate proceeding under the Bihar Public Land Encroachment Act against the persons who have encroached the Gair Mazarua Malik Land appertaining to Thana No. 16, Khata No. 128, Survey

Patna High Court CWJC No.11576 of 2022(2) dt.01-05-2023 2/2 Plot No.199 Area 2 decimals and Survey Plot no.219 Area 12 decimals situated in Mauza-Govindpur Kurtha, P.S.- Fatuha, District-Patna.

ii) To issue an appropriate writ, preferably in the nature of mandamus commanding upon the respondent authorities more particularly the respondent no.4 to scientifically measure the public path situated over Khata No. 128, Plot No. 199 and 219 and then to grant no objection certificate to the Nagar Parishad, Fatuha, Patna for construction of drainage and P.C.C. Road over the same."

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the respondent-authorities for redressal of their aforesaid grievances. Liberty so sought is granted.

The writ petition stands disposed off as not pressed.
