2. The petitioner apprehends his arrest in connection with Adhaura P.S. Case No. 58 of 2022, registered for the offences punishable under Section 341, 323, 324, 326 and 307/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner was arrested in the case on 08.02.2024 when by order dated 09.10.2023 it was clearly directed that in the meantime no coercive steps shall be taken against the petitioner in the aforementioned case till further order of this Court, it is next submitted that once no coercive step was directed until further order of the Court, then whether

No.47081 of 2023(4) dt.22-02-2024 2/2 the petitioner could have been arrested if the subsequent order had not vacated the order granting no coercive action against the petitioner. The learned counsel for the petitioner thus submits that since the petitioner has been arrested, as such, the present anticipatory bail application has become infructuous. It is next submitted that petitioner will file an appropriate case for initiating contempt proceedings against the police official who arrested the accused and the learned Magistrate who remanded the petitioner to custody in a mechanical manner.

4. Thereafter, the learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application.
