The petitioner seeks regular bail in connection with Hathauri PS case no. 149 of 2016 instituted for the offences punishable under Sections 272, 273, 290 of Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of various brands of foreign liquor from the house of the co-accused. It is submitted by the learned counsel for the petitioner that the petitioner is innocent, the recovery was made from the house of the co-accused person who has already been granted bail and as far as criminal antecedent of the petitioner is concerned, there are three other cases wherein same and similar

It is further submitted that the petitioner is in custody since 20.09.2017 Considering the nature of accusation and the period of custody undergone, I deem it fit and appropriate to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Muzaffarpur in connection with Hathauri PS case no. 149 of 2016. It is further directed that the petitioner would mark his attendance before the officer-in-charge of the concerned PS at 10 am on every Monday of the week and in case of two consequent defaults, the present privilege of bail shall stand withdrawn and the petitioner shall be taken into custody forthwith.
