Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 4.7.2017 passed in Cr. Misc. No.23872 of 2017, with a direction to the learned trial court to expedite the trial of the petitioner and try to conclude the same within a period of nine months.

Learned counsel for the petitioner has submitted that up till now, commitment of the case has not been made and the petitioner is in custody since 10.1.2017.

Heard learned A.P.P. also.

Having heard both sides as stated above, the learned District Judge, Muzaffapur is directed to see that the case is

Patna High Court Cr.Misc. No.1284 of 2018 (2) dt.10-01-2018 2/2 committed to the court of session and if it requires separation of the case of the petitioner from the other accused persons, the case of the petitioner shall be separated from the other accused persons and after commitment of the case, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible. The District & Sessions Judge, Muzaffarpur shall monitor it.
