Petitioner, already in custody, seeks bail in connection with Sitamarhi P.S. Case No.826 of 2017, registered under Sections 381/34 of the Indian Penal Code.
Allegation in brief is that Rs.11,93,000/- was handed over by the son of the informant to the petitioner to deposit in his bank account but it was not deposited and misappropriated by the petitioner.
Learned counsel for the petitioner submits that the case was lodged after delay of seven days, in fact the petitioner was returning back on train after collecting money from shopkeepers to whom jewellery was supplied and in this regard he lodged a case, the petitioner is in custody since 15.10.2017 and he has no

Learned counsel for the informant submits that case instituted by the petitioner was found false after investigation. Having considered the said facts and circumstances, petitioner Jitendra Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Sitamarhi P.S. Case No.826 of 2017 with condition that the petitioner shall remain present on each and every date before the trial court and in case of his absence on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
