JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-11-2022 The learned counsel for the petitioners has submitted that the petitioners have filed a case under the provisions of the Bihar Building (Lease, Rent & Eviction) Control Act, 1982 bearing BBC Case No. 7/2021, which is pending before the learned Court of House Controller-cum-SubDivisional Officer, Patna Sadar, Patna, but since the petitioners are being deprived of the necessary civic amenities, the House Controller-cum-SubDivisional Officer, Patna Sadar, Patna i.e. the

Patna High Court CWJC No.16340 of 2021(2) dt.22-11-2022 2/2 Respondent No. 2 herein be directed to consider this aspect of the matter and pass appropriate orders.

Having regard to the limited prayer made by the petitioners in the present writ petition, this Court deems it fit and proper to dispose of the present writ petition with liberty to the petitioners to file appropriate petition before the Respondent No. 2, in the aforesaid pending BBC Case No. 7/2021, for restoration of the necessary amenities and in case, such a petition is filed within a period of four weeks from today, appropriate orders shall be passed thereon, in accordance with law, forthwith.

The writ petition stands disposed of on the aforesaid terms.
