Petitioners apprehend arrest in a case registered for the offence punishable under Sections 341, 323, 307, 379, 504, 34 of the IPC.

As per the prosecution case, the petitioners along with other co-accused persons assaulted the informant and his son by means of lathi-danda as a result of which both of them sustained injuries and also the petitioners snatched away Rs. 2000/- from the informant's son along with a golden chain.

Patna High Court CR. MISC. No.44089 of 2022(2) dt.05-12-2022 2/2 Learned counsel appearing for the petitioners submits that the present case is a counter-blast of Basantpur P.S. Case No. 115 of 2022 lodged by petitioner no.2 against the informant and his family members. As a matter of fact, a free fight took place between the parties in which both sides sustained injuries. Case and counter case. Petitioners have got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Basantpur Police Station Case No. 114 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
