JUSTICE RAVI RANJAN ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offences punishable under sections 409, 420, 477A, 218, 120B and 486 of the Indian Penal Code.

As per the allegation, the petitioner along with other coaccused persons has misappropriated Rs. 2,59,080/- which was to be given to the complainant under MANREGA scheme. It is contended that the complainant can claim payment for 100 days only but he has claimed payment for 200 days in a year which is unbelievable as maximum payment for 100 days is only permissible in a year. It is further contended that the accused persons, who are Ex-Panchayat Rojgar Sevak, present Panchayat

Patna High Court Cr.Misc. No.57573 of 2015 (2) dt.22-01-2016 Rojgar Sevak and present Mukhiya, have already been granted anticipatory bail vide order dated 11.12.2015 passed by this Court in Criminal Miscellaneous No. 56340 of 2015.

Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Ram Pukar Sah, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Complaint Case No. 74/2013 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Dhirendra Kumar, Judicial Magistrate, Ist Class, Dehri-on-sone, Rohtas, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
