JUSTICE BIRENDRA KUMAR ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 341, 323, 504 of the Indian Penal Code and Section 3(i)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The petitioner is on police bail as submitted by learned counsel for the petitioner.

After submission of the charge-sheet no service of summon was affected against the petitioner, allegedly, and nonbailable warrant of arrest has been issued. The court below shall consider the prayer for bail of the petitioner in the light of the order of this Court in the case of Mahendra Prasad Singh Vs. State
