2. Mr. Parshuram Singh, SHO Nowkothi, Begusarai and Mr. Manish Kumar Singh, SHO Sahebpur, Begusarai have come along with the petitioner and Opposite Party No. 2 in person.

3. It has been informed by both the SHO that they have tried their best to settle the dispute, between petitioner and Opposite Party No. 2, amicably and the petitioner has willingly

Patna High Court CR. MISC. No.44171 of 2022(8) dt.03-05-2023 2/3 agreed to make payment of Rs. 4,50,000/- to get rid of criminal case pending against him.

4. The petitioner who is present in Court in person has also agreed to pay Rs. 4,50,000/- to the Opposite Party No. 2 to get rid of criminal case pending against him.

5. Considering the effort taken by the two police officers who have finally resolved the dispute between the parties, the present bail application need not require any further adjudication.

6. This Court directs the Court below to release the petitioner provisionally on pre-arrest bail on such terms and conditions as fixed by the Court below subject to the condition that the petitioner who has willingly agreed to handover Rs. 4,50,000/- to the Opposite Party No. 2, the same be done by the petitioner within a period of three months either in installments or full payment at once.

7. The provisional bail granted to the petitioner shall be made absolute once the petitioner finally deposits the amount in the account of Opposite Party No. 2 within the aforesaid time.

8. In case the petitioner does not abide by the condition imposed by this Court the present order will automatically loose its force.

9. The personal appearance of the two police officers is dispensed with.
