2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 307, 504 and 34 of the Indian Penal Code .

3. As per the prosecution case , on 01.07.2023 at about 04:00 P M this petitioner along with two to three unknown persons came at the door of informant and assaulted the son of informant with legs, fist, stone and bricks due to which son of informant sustained injuries.

4. Learned counsel for the petitioner submits that allegation of assault is general and omnibus against this petitioner. During course of investigation , the injured son of

Patna High Court CR. MISC. No.46205 of 2024(4) dt.05-09-2024 2/2 informant was examined but he did not name this petitioner as one of the assailants, which is evident from paragraph-79 of the case diary . Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM XIVth Patna Sadar Patna in connection with Phulwarisharif P.S. case No. 956 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
