====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 16-11-2017 Heard Sri Kartik Kumar Sinha, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 28.08.2017 in Sono (Charkapathar) P.S. Case No.195 of 2017 registered for the offence under Sections 341/323/307/504/34 of the Indian Penal Code, has prayed for grant of bail.

By way of referring to Annexure-2 to the petition i.e. photo copy of F.I.R. of Sono(Charkapathar) P.S. Case No.194 of 2017 registered for the offence under Sections 341,323/ 307/504/34 of the Indian Penal Code, in which brother of the petitioner was the informant, learned counsel for the petitioner submits that the informant of the said case was FIR named accused. He submits that with a view to create a defence, the present case was lodged

Patna High Court Cr.Misc. No.55304 of 2017(2) dt.16-11-2017 2/2 against the petitioner and others and even in the present F.I.R. the allegation has been made regarding use of Lathi in the occurrence. Learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. Considering the nature of accusation, clean antecedent of the petitioner as well as the fact that from the petitioner's side firstly F.I.R. was lodged, let the petitioner, namely, Mahadeo Thakur be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Sono (Charkapathar) P.S. Case no.195 of 2017.
