JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Special Case No. 3486 of 2017 arising out of Phulwarisharif (Janipur) P.S.Case No. 417 of 2017 registered under Sections 30(a)(B)(c), 38(i) and 41 (i) of the Bihar Prohibition and Excise Act, 2016 Allegation in brief is that from a Magic Taxi 432 litres of foreign liquor was recovered and petitioner and others were found sitting in the vehicle.

Submission is that petitioner is not the owner nor the driver of the vehicle rather he was merely a passenger and other similarly situated co-accused have been admitted to bail by a co-ordinate Bench of this Court vide order dated 16.11.2017 passed in Cr. Misc. No. 53795 of 2017 and vide order dated 18.09.2017 passed

Patna High Court Cr.Misc. No.69 of 2018 (2) dt.30-01-2018 2/2 inn Cr. Misc. No. 45413 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Sumit Kumar @ Sumit Singh is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna in connection with Special Case No. 3486 of 2017 arising out of Phulwarisharif (Janipur) P.S.Case No. 417 of 2017.
