====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 20-01-2016 I have heard learned counsel for the petitioner and the State.

The petitioner apprehends his arrest in connection with Chewra P.S. Case No. 39 of 2015 registered for offences punishable under Sections 414/120(B) of the Indian Penal Code and Rule 4/40 of B.M.M.C. Rule 1972 and 6/7 of Bihar 2003 Act. It is contended that the petitioner is a truck owner and unfortunately the driver at the time of checking could not produce the Challan and Gate Pass, which has been appended as Annexures as 2 and 2/A. The driver was apprehended and thereafter released on bail. The petitioner claims to be the owner of the truck and also claims that he is having clean antecedent. Case No. 39 of 2015 on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Shekhpura subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
