JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-07-2021 As prayed for, through Video Conferencing, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide its notes dated 24/26.12.2020, within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioners and the learned A.P.P. for the State, through Video Conferencing. The petitioners apprehend their arrest in connection with Rajauli P.S. Case No.08 of 2020 registered under Sections 147, 148, 149, 341, 323, 307, 504, 379 and 427 of the Indian Penal Code besides Section 27 of the Arms Act.

No.40456 of 2020(2) dt.23-07-2021 2/3 The accusation is that 12 persons, named in the F.I.R., including the petitioners variously armed with weapons came at the door of the informant Rajesh Yadav and started to abuse. When the informant made protest, then all started to cause assault to the informant through lathi, danda, legs and fists. Thereafter, Shankar Yadav, Sakindra Yadav and Pramod Yadav fired through pistol at the informant, which hit at left leg and right cheek of Kishori Yadav, the brother of the informant, whereas one firing hit at the forehead of Sanju Devi, the niece of the informant, and both sustained injuries. At that time, Sakindra Yadav entered into the house of the informant and took the silver ornaments of the mother of the informant. Learned counsel for the petitioners submits that it would appear from the F.I.R. that while the petitioners are named in the F.I.R. along with others but there is no specific allegation against the petitioners. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like
