JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Azam Nagar P. S. Case No. 200 of 2015 registered under Sections 272, 273 and 290 of the Indian Penal Code and 47(a) of the Excise Act.

It is contended that the petitioner being a lady has got no criminal antecedent. The alleged recovery was not made from her conscious possession and she has been implicated in the case merely on suspicion.

Per contra, learned counsel for the State has vehemently opposed the application for grant of anticipatory bail to the

Be that as it may, regard being had to the nature of the offence and the other facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, 1st Class, Katihar in Azam Nagar P. S. Case No. 200 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
