The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 326, 307, 504 of the Indian Penal Code.

It is alleged that 16 First Information Report named persons including the petitioners came variously armed and attacked on the informant's side. The accused persons assaulted the uncle of the informant, causing grievous injury. When the cousin brother of the informant Ravindra Paswan and Sunaina Devi came to rescue when they were also assaulted by the accused persons and

Patna High Court Cr.Misc. No.3130 of 2016 (2) dt.20-01-2016 snatched mobile and torch.

It is submitted by the learned counsel for the petitioners that injury of the uncle of the informant has been found to be grievous, but allegation is omnibus and general. There is counter version of the occurrence. Though, accusation of firing is against petitioner Mishri Paswan, but no injury has been caused to anyone. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Considering the accusation being omnibus and general, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Noorsarai P.S. Case No. 206 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
