The petitioner seeks bail in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 22.5 litres country made liquor was recovered from a tempo which was being boarded by two persons. It is further contended that petitioner does have any connection with the illicit liquor as obviously another person who was boarding the tempo escaped from the scene. Petitioner is claimed to be driver of the aforesaid tempo. Petitioner claims that he is having clean antecedent and is in custody since 26.09.2017, i.e., for about
Patna High Court Cr.Misc. No.54877 of 2017(2) dt.23-11-2017 2/2 two months.
Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge-cum-Special Judge, Excise Purnea in connection with Special Excise Case No. 2493/2017 arising out of Kasba P. S. Case No. 186/2017. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
