JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 Earlier prayer for bail of the petitioner was rejected twice by this Court vide order dated 17.11.2017 passed in Cr.Misc.No. 49517 of 2017 and again vide order dated 28.3.2018 passed in Cr.Misc.No. 7666 of 2018. Petitioner is husband and allegation against him is of causing dowry death to his wife.

Submission of learned counsel for the petitioner is that three witnesses have been examined and they have been declared hostile and viscera report does not show the cause of death and petitioner is in custody since 26.5.2017. Heard learned APP also.

Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.

No.69358 of 2018(3) dt.02-01-2019 2/2 However, once the informant and his family members are examined, the petitioner may renew his prayer for bail before the trial court itself, which will be considered on the basis of materials available on record at that time and to be disposed of by passing an appropriate order.

With the above observation, this application is dismissed.
