ANJANA MISHRA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/323/307/504 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that admittedly the allegation of firing is on one Rahul Mishra and not against this petitioner. It is further submitted that the injury is said to have been found to be simple in nature. It was also submitted that admittedly the petitioner No. 1 is said to have been present there only and is alleged to have given the order whereas petitioner No. 2 has had no role to play.

Patna High Court Cr.Misc. No.57633 of 2015 (3) dt.05-05-2016 P2/2 Considering the aforementioned facts and circumstances and that the petitioners have no criminal antecedent, let the petitioner, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gopalganj in connection with Bishambharpur P.S. Case No. 54 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
