The admitted position is that the petitioner has been put back in service subject to the conditions which are evident from the counter affidavit, including payment of Rs. 5000/- per month to his mother, namely, Smt. Durga Devi.

In view thereof, the parties are in agreement that nothing remains in the writ petition and that it has become infructuous. This Court accepts such submission of the counsels representing the petitioner as well as State.

Learned counsel for the petitioner submits that since the

Patna High Court CWJC No.1887 of 2021(8) dt.31-08-2022 2/2 issue was resolved amicably, the authorities may consider making payment of back wages for which he will be filing a representation before the competent Authority. With liberty to avail remedy by way of representation, application is disposed of.

Since respondent No.5 has not been noticed and is not appearing in these proceedings, this Court would observe that any decision on petitioner's claim should be taken after hearing respondent no.5.
