JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2019 This is an application for grant of anticipatory bail in connection with Nanpur P.S. Case No. 290 of 2018, disclosing offences under Sections 498A, 341, 323, 354, 379, 594, 506, 34 of IPC.

F.I.R. disclosed an allegation that opposite party no.2 filed a maintenance case against the petitioner and others and while she was coming with her father after Pairvi in the Court, then the petitioner and other abused and threatened to withdraw the case, on protest by her, they were assaulted by her. Patna High Court CR. MISC. No.44281 of 2019(2) dt.18-07-2019 2/2 lodged a case against the informant and other with respect to attempt to kill him by administering poison, when he came to know about the same, the present case has been filed. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M. Sitamarhi, in connection with Nanpur P.S. Case No. 290 of 2018, , subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he will co-operate in the disposal of the maintenance case filed by the informant against the petitioner and will not create any hindrance in that.
