This application, for grant of anticipatory bail, arises out of Karakat P.S. Case No. 35 of 2014, disclosing offences under Section 436 read with Section 34 of the Indian Penal Code.

The allegation in the First Information Report is that when the informant was taking meal in her house with the family members, the accused persons were

Patna High Court Cr.Misc. No.44608 of 2016 (2) dt.27-10-2016 2/3 attempting to take away vegetables from the land belonging to the informant. On objection having been raised, the accused persons are said to have abused the informant and set her house on fire.

Learned counsel for the petitioners has submitted that the informant has subsequently filed an application before the Circle Officer, Karakat, stating different reason because of which her house had caught fire. It has also been submitted that the parties have resolved their disputes amicably.

Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj (Rohtas), in connection with Karakat P.S. Case No. 35 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required

Patna High Court Cr.Misc. No.44608 of 2016 (2) dt.27-10-2016 3/3 and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
