The petitioner apprehends his arrest in connection with Lakhisarai P.S. Case No. 747 of 2018 registered under Section 409 of the Indian Penal Code.

The accusation is that petitioner being the President of Jai Jagdamba Schedule Case and Backward Classes Upvokta Bhandar Swablambi Co-operative Committee, Salaunachak, Lakhisarai, misappropriated the amount of Rs.63517/-. In spite of notice given by the District Co-operative Officer, Lakhisarai, petitioner did not deposit the aforesaid amount. Learned counsel for the petitioner submits that while the petitioner has given the realized amount of

No.43952 of 2019(2) dt.18-07-2019 2/2 Rs.63517/- to the members of committee but he is still ready to pay Rs.63517/- in the account of Jai Jagdamba Schedule Case and Backward Classes Upvokta Bhandar Swablambi Cooperative Committee, Salaunachak, Lakhisarai. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai P.S. Case No. 747 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

It is made clear that the bail bond of the petitioner will be accepted by the learned court below on showing the receipt of Rs.63517/-.
