JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 468, 406, 323 and 504/120B of the Indian Penal Code.
The prosecution case is that one Manoj Prasad and Sonari Prasad sold certain piece of land to different persons after realizing the consideration money. Subsequently, Kameshwar Mahto and his wife Manti Devi petitioner no.2 executed sale deed with regard to the same land in favour of petitioner no.1 Kiran Devi and others.
It is submitted by learned counsel for the petitioners that petitioner no.2 has sold her own share of land and petitioner no.1 is bona fide purchaser whereas co-accused Ghanshyam Prasad,
Patna High Court Cr.Misc. No.57979 of 2015 (2) dt.04-01-2016 2/2 Rambalak Prasad and Rajendra Prasad Yadav have been granted anticipatory bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No.18612 of 2015.
Considering the accusation arising out of share dispute, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Rajauli P.S. Case No.101/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
