JUSTICE BIRENDRA KUMAR ORAL ORDER 05-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 498(A), 354 of the Indian Penal Code.

This is a case under Section 498A I.P.C.

The parties have settled their dispute before the Mediator. In terms of settlement, a cheque of Rs.1,25,000/-(One Lac Twenty Five Thousand) in the name of Ragini Kumari has been handed over to the learned counsel for Ragini Kumari and the rests amount shall be paid through cheque before the

Considering the settlement of dispute, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Complaint Case No.C1/83/18, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

The petitioner shall follow the terms and conditions of the settlement before the Arbitrator, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner.
