JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-05-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). That by way of this writ application the petitioner seeks indulgence of this Hon'ble Court for issuance of appropriate writ/order/ direction in the nature of mandamus restraining the respondents from taking possession over the land by force appertaining to C.S. Khata No. 200, R.S. Plot no. 335, C.S. Plot No. 185, Plot no. 632. Thana No. 164, situated in Hausa Habbi Belauna, District- Darbhanga.

Patna High Court CWJC No.9629 of 2014(4) dt.08-05-2024 2/2 (ii). Further to direct the Collector, Darbhanga (Res. No. 3) to stop forthwith soil filling work or any construction over the said land."

At the outset, the learned counsel for the petitioner submits that he has instructions to state before this Court that the power grid station, which was to be constructed over the plots of the petitioner, is no longer being now constructed over the plots of the petitioner and the said project has been shifted to some other place, hence, at the moment, the present writ petition has been rendered infructuous, however, the petitioner be granted liberty to seek redressal of his grievances, by taking recourse to the due process of law, in case need so arises in future. Liberty, so sought, is granted.
