The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 307, 504, 379/34 of the Indian Penal Code.

As per allegation in the FIR, while the informant was sitting at his door, several accused persons entered into his house and on order of co-accused Sujeet Kumar, petitioner assaulted him by knife on his head, back and stomach as a result of which he sustained injuries.

It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. Only with a view to save the skin from Ben P.S. Case No. 97 of 2020, which was lodged by the petitioner against the

Patna High Court CR. MISC. No.45242 of 2022(3) dt.17-01-2023 2/2 informant and his family members, the present case has been lodged as counter blast. Allegedly, petitioner has given knife blow but it reveals from injury report that injuries were caused by hard and blunt substance, which are contradictory. Petitioner is languishing in judicial custody since 10.06.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMI, Biharsharif, Nalanda in connection with Ben P.S. Case No. 109 of 2020.
