2. The petitioner is apprehending his arrest in connection with Dighwara P.S. Case No. 129 of 2023 dated 16.04.2023, registered for the offences punishable under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016 pending in the Court of learned Additional District & Sessions Judge, 2nd Cum 1st, Exclusive Special Judge Excise, Saran at Chapra.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
