The petitioner apprehends his arrest in Daudnagar P.S. Case No. 93/2009, registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is said to have fired causing injury in the abdomen of the brother of the informant.
Mr. Vikramdeo Singh learned counsel for the petitioner submits that petitioner has falsely been implicated in the case. The police after investigation submitted final form finding the case false, but learned Chief Judicial Magistrate took cognizance. It is submitted that main accusation is found false and
Patna High Court Cr.Misc. No.46556 of 2016 (3) dt.11-01-2017 2/2 that is why the police submitted final form, but in view of the allegation made against the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced by this order.
