The petitioner seeks regular bail in connection with Lakhisarai P.S. Case No. 409 of 2013 for the offences punishable under Sections 399, 402, 414 and 413 of the Indian Penal Code.

The case of the prosecution is that upon receiving secret information, the police force had raided the premises in question and apprehended the accused persons, who were said to have been conspiring for committing some crime and mobile phones, stolen motorcycles etc. were recovered from the said place. Later on, it transpired that the petitioner is also one of the accomplices of the said accused persons, who were apprehended

The learned counsel for the petitioner submits that the petitioner was languishing in jail in another case and has been remanded in the present case on account of his earlier criminal antecedent, however, neither the petitioner was arrested from the spot nor any incriminating article has been recovered from the petitioner. The petitioner is accused in one another case in which he is on bail and is languishing in custody since 10.06.2015. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 409 of 2013.
