The petitioner seeks bail in Naya Ram Nagar P. S. Case No. 79 of 2017 instituted for the offence under Section(s) 341, 323, 307, 302 and 504/34 of the Indian Penal Code ande section 27 Arms Act.
Earlier prayer of the bail of the petitioner was rejected by co-ordinate Bench of this Court vide order dated 19.1.2018 passed in Cr. Misc. no. 63510 of 2017 with observation to renew prayer for bail after nine months if trial is not concluded. Report called for from the Court below has been received and placed at Flag- X, wherein it is mentioned that the case is fixed for defence witness. It is further mentioned in the
Patna High Court Cr.Misc. No.68624 of 2018(3) dt.17-12-2018 2/2 report that trial is likely be to be concluded within two months . Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of two months after X'mas holidays by giving short adjournments as mentioned in the report and send compliance report.
Petitioner may renew his prayer for bail in the event trial is not concluded within the aforesaid period. (Sanjay Priya, J) shyambihari/- U T
