This application for grant of anticipatory bail arises out of Shikarpur P. S. Case No. 248 of 2015, disclosing offences under Sections 419,420/34 of the Indian Penal Code. It is alleged that the petitioner was an aspirant for appointment to the post of Constable (GD) in CentralArmed Forces and he made co-accused Rajesh Sah to participate in the process of selection in his place by an act of impersonation. Said Rajesh Sah has been arrested. The First Information Report has been lodged on the basis of information given by the Inspector (Adm.), 27 B.N. S.S.B. Narkatiaganj.

Learned counsel for the petitioner has submitted that no offence of impersonation is made out against the petitioner. He has also submitted that if granted anticipatory bail, there is no chance of tampering with the evidence. The prosecution case is based on documents.

Considering the above submission, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within four weeks from today in the court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Shikarpur P. S. Case No. 248 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
