JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2018 By way of the present application, petitioner seeks modification of the order dated 19.07.2017 passed in Cr. Misc. No. 30252 of 2017, vide which the petitioner was allowed the privilege of bail. However, subsequently it revealed that petitioner has one criminal antecedent, which was not disclosed earlier in the bail petition and accordingly, his bail bond was not accepted. It appears that earlier a notice was issued to the deponent, who had sworn the affidavit in Cr. Misc. No. 30252 of 2017 and now he has filed an affidavit, in which it has been stated that he is a poor person and was working in Gujarat for earning his livelihood and he was not aware of the fact that petitioner is involved in another case and he undertakes not to repeat such mistake in future and has tendered his apology. In view of the facts and circumstances of the case, let para -

Patna High Court Cr.Misc. No.54276 of 2017 (3) dt.10-01-2018 4 of the order dated 19.07.2017 is modified to the extent that petitioner is accused in one more case.

All other direction /condition stipulated in the said order shall remain intact.

Let a copy of this order be communicated to the court concerned, forthwith.
