Petitioner seeks bail in a case registered for the offences punishable under Sections 448, 376 of the Indian Penal Code and Section 4 of the Prevention of Children from Sexual Offence Act.

Allegation against the petitioner is of commission of rape against a minor girl.

The report of the learned Trial Judge would reveal that charges were framed on 24.08.2018, however, no prosecution witness has been examined up-till-now. The Superintendent of Police, Aurangabad shall ensure production of prosecution witnesses in connection with Aurangabad Mahila P.S.Case No.04 of 2018 pending

Patna High Court CR. MISC. No.70077 of 2018(4) dt.03-06-2019 2/2 before the court of learned 1st Addl. Sessions Judge-cum-Spl. Judge (POCSO) Act, Aurangabad.

The witnesses must be produced within six months.

The learned Trial Court is directed to not to allow unnecessary and long adjournment in the case. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail at this stage in connection with Aurangabad Mahila P.S.Case No.04 of 2018 pending before the court of learned 1st Addl. Sessions Judgecum-Spl. Judge (POCSO) Act, Aurangabad. Hence, prayer is refused.
