Petitioner seeks regular bail in connection with Khagaria (Gangaur) PS Case No. 947/2019 registered for the offence punishable under Sections 25(1-b)a, 26 of the Arms Act. The allegation, as per First Information Report, is that the police intercepted the petitioner and recovered one loaded country made pistol along with nine cartridges from his possession.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to oblique motive and the seizure list has not been prepared as per the provision of Section 100 CrPC. Learned counsel further submits

Patna High Court CR. MISC. No.40189 of 2020(2) dt.20-02-2021 2/2 that petitioner is in custody since 22.12.2019 and charge-sheet has already been submitted in the matter and there is no likelihood of petitioner to abscond or to tamper with the evidences.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 22.12.2019 and the chargesheet has already been submitted in the matter and there is no likelihood of petitioner to abscond or to tamper with the evidences, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, ANIL YADAV be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Gangaur) PS Case No. 947/2019. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
