Learned counsel for the petitioners submits that petitioner no. 1 has been arrested and he does not wants to press this application against petitioner no. 1.

Permission is granted.

The application as against petitioner no. 1 is dismissed as not pressed and is restricted to petitioner no. 2 only.

The petitioner no. 2 seeks bail in anticipation of his arrest in connection with Nautan P.S. Case No. 58 of 2021 instituted for the offences punishable under Section 395 of the Indian Penal Code.

Patna High Court CR. MISC. No.53317 of 2021(2) dt.18-02-2022 2/2 Taking into consideration the fact that robbery has been committed with using of firearms, and that the petitioner no. 2 being found to be involved during investigation an interrogation of those who are arrested, I am not inclined to grant anticipatory bail to the petitioner no.2, as he is required for the purposes of custodial interrogation and identification and recovery too.

This application is dismissed.
