JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-01-2019 The petitioners seeks bail in anticipation of their arrest in connection with Parbatta P.S. Case No. 179 of 2018 dated 20.05.2018 instituted for the offences under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code.

Though the petitioners are said to have assaulted the informant and others and divested them of their personal belongings but learned counsel for the petitioners submits that the case has been lodged because of the earlier case lodged against the informant and others from the side of the petitioners. The petitioners as well as the informant are cosharers and there is a pending land dispute between them.

Considering the background facts and the parties being agnates/co-sharers and there being a pending land dispute coupled with the fact that petitioners do not have any criminal antecedents, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Khagaria in connection with Parbatta P.S. Case No. 179 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
