The petitioner apprehends his arrest in Obra P.S. Case No.229 of 2018 registered under Section 307 and other minor Sections of the Indian Penal Code.

The learned counsel for the petitioner submits that there is omnibus and general allegation of assault against the petitioner and others. 19 co-accused persons have already been enlarged on anticipatory bail. The case of the petitioner stands on better footing. There is a counter version being Obra P.S. Case No.172 of 2018 and co-accused Yogendra Paswan also lodged Obra P.S. Case No.230 of 2018. It is further submitted that petitioner has got no criminal antecedent and 19 co-accused persons have already been enlarged on anticipatory bail.

No.41010 of 2019(2) dt.03-07-2019 2/2 Taking into consideration the facts aforesaid and nature of allegation made against the petitioner and the fact that there is omnibus and general allegation of assault against the petitioner and other similarly situated persons have already been granted anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, DistrictAurangabad in connection with Obra P.S. Case No.229 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
