JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Muffasil P.S.Case No. 236/08 registered under Sections 147, 148, 149, 201, 302, 307, 342, 364 and 447 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that two persons, namely, Giro Singh and Shiv Jatan Mandal were killed by 30 FIR named accused persons by firearm.

Submission is that other co-accused persons, namely, Guddu Yadav, Mukesh Yadav and Dharnidhar Yadav have been admitted to bail by the co-ordinate Benches of this Court vide order dated 29.01.2013 passed in Cr. Misc. No. 45429 of 2012, order dated 17.02.2014 passed in Cr. Misc. No. 1786 of 2014 and order dated 22.10.2014 passed in Cr. Misc. No. 43153 of 2014

Patna High Court Cr.Misc. No.4582 of 2018 (5) dt.05-04-2018 2/2 respectively and the allegation is general and omnibus. The case is of the year 2008 and chargesheet has been submitted against the petitioner as absconder and he has surrendered only on 18.09.2017.

Having considered the aforesaid facts and circumstances, the petitioner remained absconder for such a long period; the prayer of bail of the petitioner is rejected. Trial court is directed to expedite the trial and conclude the same preferably within one and half years.
