The petitioner seeks bail in Hatua P. S. Case No. 46 of 2018 instituted for the offence under Section(s) 363 and 366 of the Indian Penal Code.
In the written report, it is alleged that daughter of informant became traceless. He learnt during search that this petitioner had kidnapped his daughter.
Learned counsel for petitioner submits that petitioner is named in the written report. Learned counsel further submits that in the Court below the evidence of the informant has been recorded. The certified copy of the aforesaid evidence has been produced which is taken on record, wherein, he has taken the name of this petitioner.
Patna High Court Cr.Misc. No.70637 of 2018(4) dt.19-02-2019 2/2 Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
The trial has already commenced and evidence of informant has already been recorded.
Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of six months from the date of receipt of copy of this order..
Petitioner may renew his prayer for bail in the event trial is not concluded within the aforesaid period. (Sanjay Priya, J) shyambihari/- U
