The petitioner is apprehending his arrest in Sakra P.S. case No.202 of 2016 registered under Sections 366(A)/34 of the Indian Penal Code, pending before the court of the A.C.J.M.-cumSub Judge 13th, Muzaffarpur. Allegation is that the accused persons including the petitioner kidnapped the minor grand daughter of the informant for some illegal purpose or to sell her.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no allegation of any inducement or physical assault alleged
Patna High Court Cr.Misc. No.50396 of 2016 (2) dt.25-11-2016 2/2 against the petitioner. Though the victim has named one of the accused to be Golu but from perusal of the F.I.R. it appears that there are two persons of the same name.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R. The victim girl has been examined under Section 164 Cr.P:.S. She has named one of the accused to be Golu.
Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected. Anyhow if the petitioner surrenders in the court below within a period of six weeks from today, the same shall be considered on its own merit without being prejudiced by this order.
